Participation Agreement
Please read this before registering. Ticking “I agree” on the registration form is your signature on this agreement, for each child you register.
- Tell us everything we need to know about your child’s health, allergies and needs.
- Our classes are hands-on, and hands-on activities carry some risk. You accept those risks and release us from claims, as explained below.
- In an emergency we call 911 and get your child care, and we call you.
- We hand children only to you or adults you name.
- We may take photos of the classes. Ask us any time and we will leave your child out.
1Who this agreement is with
This agreement is between you, the parent or legal guardian registering the child (“you”), and Keren Miriam Inc., a Maryland 501(c)(3) nonprofit operating as Miriam’s Library and Learning Center (“Miriam’s Library”, “we”). It covers every session, class, trip and activity of the after-school program your child takes part in, including transportation if you choose it. You confirm you are the child’s parent or legal guardian, are at least 18, and have the authority to agree to this for your child.
2Information about your child
You agree to tell us, when you register and whenever anything changes, about your child’s allergies, medical conditions, medications, learning needs and anything else that could affect their safety or the safety of others. We rely on what you tell us. We will share it only with the staff and instructors who need it to care for your child, and with emergency responders when needed.
3The activities, and their risks
Our sessions are hands-on. Depending on the session, children may use ovens, hot tools, knives and food ingredients (baking); inks and screens (screen printing); heated styling tools (hairstyling); cut tile, glass pieces and grout (mosaic); hot 3D-printer parts; and instruments. Food made in class may contain common allergens. We are not an allergen-free facility, and we cannot guarantee that any food, ingredient or material is free of any particular allergen. Children may also travel between school and our building, move around the building, and play. Even with supervision and care, these activities carry risks, including cuts, burns, allergic reactions, falls and other injuries.
You understand these risks and choose to have your child take part. You agree that your child will follow the instructions of our staff and instructors.
Please keep your child home if they are unwell or may be contagious, and tell us before the class.
4Release of claims
To the fullest extent permitted by Maryland law, you, on your own behalf and on behalf of your child, release, waive and agree not to bring any claim against Keren Miriam Inc. and its directors, staff, instructors, volunteers and agents for any injury, illness, loss or damage arising from your child’s participation in the program, including claims arising from the ordinary negligence of any of them.
This release does not apply to gross negligence, reckless conduct or intentional harm. If any part of this section is found unenforceable, the rest of it remains in effect to the fullest extent the law allows.
5Medical emergencies
Our staff are not medical professionals. If your child is hurt or becomes ill, you authorize our staff to give first aid, to call 911, and to have your child taken to a hospital and treated by medical professionals if they judge it necessary. We will try to reach you, and then your emergency contact, as quickly as possible. You are responsible for the cost of any medical care.
We do not give medication. If your child has a prescribed epinephrine auto-injector or inhaler, it must come with them, labeled with their name. In an emergency staff may help your child use it and will call 911.
6Drop-off, pick-up and transportation
We supervise children only during their scheduled class time. Please bring your child on time and collect them on time. We release children only to you or to an adult you authorize in writing (an email to us is fine); we may ask for identification. If nobody arrives, we will call you and then your emergency contact. If you choose transportation from school, you authorize us to collect your child from the school you name and bring them to our building. It is your responsibility to tell us of any change, such as an absence or early dismissal, as early as possible.
7Behavior
We expect every child to be kind, safe and respectful. If a child’s behavior puts themselves or others at risk, we will call you, and we may ask you to collect your child or end their participation. Any refund then follows section 9.
8Photos and video
We may photograph or film classes and use those images to share with families and to tell the story of Miriam’s Library, including on our website, in print and on social media. We never publish a child’s full name with a photo. If you would rather your child not appear, send us a message at any time and we will leave them out from then on.
9Payments, refunds and cancellations
The price of a session covers all six classes. If you withdraw your child, refunds are worked out for each session from that session’s first class:
More than 7 days before the first class: 90% of what you paid is refunded.
Within 7 days of the first class, until it begins: 75% is refunded.
Once classes have begun: we refund the classes still to come, less 30%. For example, withdrawing a $189 session with four classes left refunds $88.20.
Gifts to the scholarship fund made with a registration are not refunded. We may change class times, instructors or rooms, or cancel a class for weather, safety or other reasons beyond our control. If we cancel a class, we will make it up or refund that class in full, and if we cancel a whole session, we refund it in full. Scholarship places follow the same rules for any amount you paid.
10Your information
We use the information you give us only to run the program, keep your child safe, and keep in touch with you about Miriam’s Library. We do not sell it. Card payments are handled by our payment processor; we never see or store your card number.
11General
Ticking “I agree” when you register is your electronic signature on this agreement, with the same effect as signing on paper, and we keep a record of the version you agreed to and when. This agreement is governed by the laws of the State of Maryland, and any dispute will be heard in the courts of Baltimore County, Maryland. It is the whole agreement between us about the program and applies to every session your child joins until we publish a new version. If any part of it is found unenforceable, the rest remains in effect.
